This Data Protection Notice (“Notice”) sets out the basis upon which nSearch Global Pte. Ltd. (“we”, “us” or “our”) may collect, use, disclose or otherwise process personal data of job applicants in accordance with the Personal Data Protection Act (“PDPA”). This Policy applies to personal data in our possession or under our control, including personal data in the possession of organisations which we have engaged to collect, use, disclose or process personal data for our purposes.
Application of This Notice
This Notice applies to all persons who have applied for any such position with us (“job applicants”).
Personal Data
As used in this Notice, “personal data” means data, whether true or not, about an employee or a job applicant who can be identified: (a) from that data; or (b) from that data and other information to which we have or are likely to have access.
Personal data which we may collect includes, without limitation, your:
- name or alias, gender, date of birth, nationality, and country and city of birth;
- mailing address, telephone numbers, email address and other contact details;
- resume, educational qualifications, employment history, professional qualifications and certifications, and employment references;
- last/current drawn salary information;
- details of your next-of-kin, spouse and other family members;
- photographs.
Other terms used in this Notice have the meanings given to them in the PDPA (where the context permits).
Collection, Use and Disclosure of Personal Data
We generally collect personal data that (a) you knowingly and voluntarily provide in the course of or in connection with your employment or job application with us, or via a third party duly authorised by you to disclose your personal data to us (your “authorised representative”, which may include your job placement agent), after (i) you (or your authorised representative) have been notified of the purposes for which the data is collected, and (ii) you (or your authorised representative) have provided written consent to the collection and usage of your personal data for those purposes; or (b) where collection and use without consent is permitted or required by the PDPA or other laws. We will seek your consent before collecting any additional personal data and before using your personal data for a purpose which has not been notified to you (except where permitted or authorised by law).
Your personal data will be collected and used by us for the following purposes, and we may disclose your personal data to third parties where necessary for the following purposes:
- assessing and evaluating your suitability for employment in any current or prospective position within the organisation;
- verifying your identity and the accuracy of your personal details and other information provided.
These purposes may continue to apply for a reasonable period after your relationship with us ends.
Deemed Consent by Notification
We may collect or use your personal data or disclose existing personal data for secondary purposes that differ from the primary purpose for which it was originally collected. If nSearch Global Pte. Ltd. intends to rely on deemed consent by notification for such secondary purposes, we will notify you of the proposed collection, use, or disclosure of your personal data through appropriate mode(s) of communication.
Before relying on deemed consent by notification, we will assess and determine that the collection, use, and disclosure of the personal data will not likely have an adverse effect on you. You will be given a reasonable period to opt out. After the opt-out period lapses, you may withdraw that deemed consent at any time.
Not providing your personal data may result in us being unable to assess your suitability for the applied position.
Legitimate Interests Exception
In compliance with the PDPA, we may collect, use, or disclose your personal data without your consent for the legitimate interests of nSearch Global Pte. Ltd. or another person. When relying on this exception, we will assess likely adverse effects and determine that our legitimate interests outweigh any adverse effect. These purposes may continue for a reasonable period after your relationship with us ends.
Withdrawing Consent
The consent you provide remains valid until withdrawn by you in writing. You may withdraw consent for any or all purposes listed by emailing our Data Protection Officer (details below). We may require reasonable time to process your request and will inform you of any consequences, including legal consequences. We generally aim to process such requests within ten (10) days.
Withdrawing consent does not affect our right to continue processing where allowed by law.
Access to and Correction of Personal Data
To (a) access a copy of the personal data we hold about you and information about our use or disclosure; or (b) request a correction or update, please write to our Data Protection Officer. A reasonable fee may apply for access requests; we will advise you before processing. We will respond as soon as reasonably possible, typically within thirty (30) business days. If we are unable to comply, we will inform you where we are not required to do so under the PDPA.
Where appropriate, we may provide access only to the personal data contained in documents, not the entire documents.
Protection of Personal Data
We implement administrative, physical, and technical measures to protect personal data, including minimised collection, access controls, encryption, anonymisation, up-to-date antivirus, regular patching, secure media erasure, web security controls, appropriate authentication measures, and regular security reviews and testing. While security cannot be guaranteed, we continually enhance our measures.
Accuracy of Personal Data
We generally rely on personal data provided by you or your authorised representative. Please inform our DPO of any updates.
Retention of Personal Data
We retain personal data as long as necessary for the purposes collected or as required/permitted by law, and will cease retention or de-identify the data when it no longer serves those purposes and is no longer needed for legal or business reasons.
Transfers of Personal Data Outside of Singapore
We generally do not transfer personal data outside Singapore. If we do, we will obtain consent where required and ensure a standard of protection comparable to the PDPA.
